July 2010 - The Law Office of Warren V. Norred has recently begun the practice of defending against illegal towing, representing more than two dozen victims of predatory towing.
There are strict rules that tow companies must follow, including proper signage, notice of towing, written contracts to enforce towing rules with apartments and other parking facilities, maximum fees, and requirements regarding payment of fees.
Texas law permits those who feel as though they were towed without cause to request a tow hearing in the Justice of the Peace Court closest to where your car was towed. This is a low-cost proceeding, typically $25, in front of a judge, where you can explain why you should not have been towed. Attorneys are not necessary for tow hearings. Sometimes the tow company has one, and sometimes they don't.

Besides the tow hearing process, a tow victim can sue a tow company for violations of the Texas Towing and Booting Act. A succesful suit can garner $1000, plus triple the fee you had to pay to get your car out, and attorney fees reimbursed. If you engage us to represent you in a civil suit against a tow company, we will also participate in the tow hearing, if possible.
